 Nebraska 12 Year Old Arrested For DUI

 Lincoln Nebraska police arrest a 12 year old boy for a DUI after colliding with a fence a stop sign and a parked car.  He apparently had a BAC of .14, nearly twice the legal drinking limit for an adult over 21.  This is not his first incident with the law, he allegedly had a similar hit and run in June.

Another Study Proves Ignition Interlocks Effective.

A professor at Duke has been studying the effectiveness of ignition interlocks.  Below is an except from a story about this study.

Duke professor Philip Cook and a collaborator write in the New York Times that while ignition-interlock devices for preventing drunk driving are ”highly effective,” they are rarely installed in the cars of people who have been known to drive while intoxicated. Cook and Maeve E. Gearing write, “People driving while intoxicated still cause about 13,000 deaths a year in the United States. And of the 1.4 million arrests made, one-third involve repeat offenders. The greatest potential of ignition interlocks is to reduce this recidivism.”

They continue, “Eight states now mandate that interlocks be installed in the cars of all drunk-driving offenders, and another 25 require them for repeat offenders or those whose blood-alcohol content was far higher than the legal limit. Still other states give judges the option to order interlock installation. But implementation of these measures has lagged. Judges often fail to order installation, even when the law requires it. Offenders routinely ignore orders to get interlocks. And in areas where the installation is voluntary, few offenders install them. In 2007, only about 146,000 interlocks were in use…The ignition interlock could be an extraordinarily effective way to prevent drunk-driving recidivism. But it can save lives only if we make sure people use it.”

Nebraska Woman Gets 2 DUI’S in Same Night

A Lincoln Nebraska woman get picked up for two DUI’s in the same night.  Not only was she picked up driving the same vehicle in both arrests, but it was also by the same officer.  This type of offense would be eliminated if there was a law requiring an ignition interlock device be installed as a condition of bond for an alcohol related offense.  Many states already have such laws on the books.  It makes it impossible to commit the same crime in that vehicle again for the duration of the installation of the interlock device.

Joba Chamberlain DUI Case Delayed.

Chamberlain who was 1 1/2 times the the legal limit when picked up on Oct. 18 last year will have to wait till January to have his case heard.  One possible sanction for this type of charge is having and ignition interlock device installed on his vehicle.

16 DWI Issued in High Visibility Checkpoint in Omaha, NE

Troopers with the Nebraska Highway Patrol used extra hours during a special enforcement to take several intoxicated drivers off the road.

“In addition to the 16 DWI arrests, 10 open container violations were issued and one juvenile was cited for Minor in Possession of Alcohol (MIP).   Five people were arrested for Driving under Suspension.   During the special enforcement effort, troopers wrote 210 citations & warnings and issued 108 violation cards.”

Cornhusker Tight End is racking up more that completion yards.

Nebraska Cornhusker tight end will get accustomed to Nebraska’s DUI laws in a hurry.  Hunter Teafatiller has been charged with his second DUI in just under 2 years.  Teafatiller will have his probation revoked and will lose his license for a year.  He will additionally serve another 10 days in jail for this offense.  Full article here.

Nebraska passes Ignition Interlock legislation, while ABI fights it in Ohio.

Sarah Longwell, who is the managing director for American Beverage Institute, was in the Ohio Statehouse last week.  She seems to pop up just about anywhere ignition interlock laws are in the works lately.  Ms. Longwell is obviously out fighting to protect the people that she represents and their profits, but at what cost?  She made a comment that, "This bill mandates that people one sip away from 0.0799 receive a punishment normally reserved for high-(blood-alcohol-content), repeat offenders,"  Truth is most legislation gives increased sanctions for those who are repeat offenders.  She has also made comments to the effect that ignition interlock legislation would prevent someone from having a beer at a ball game, or a glass of wine with dinner.  She somehow forgets that ignition interlocks are not being installed on people who have not already shown a lack of ability to stay under the LEGAL limit of .08.  Even though she says it is more dangerous to talk on a cell phone while driving than to be at .08.

Another interesting statement that she made, "While both have committed a crime, they are very different types of criminals.".  I want to ask her how someone becomes a repeat offender without ever being a first time offender?  She often tries to separate repeat offenders from 1st time offenders as two completely different groups of people.  I know it may seem like a hard concept but repeat offenders were 1st time offenders at one point as well.  As New Mexico has shown, implementing ignition interlocks for 1st time offenders has the ability to lower alcohol related accidents by 35%. 

Even while the ABI opposes ignition interlock laws states are seeing through to the facts.  Many states have ran and passed new or enhanced ignition interlock laws.  Although the first time offender ignition interlock bill in Kansas this year will be studied over the summer, Nebraska Senate passed LB 497 this session. 

LB 497 expands and broadens the use of ignition interlock in Nebraska.  This bill now includes interlock for all first offenders who refuse to take a preliminary breath test.  First time refusal now will end in the use of ignition interlock in Nebraska as well.  LB 497 has been signed by the Governor and has an emergency clause that makes it effective immediately. 

Nebraska Woman Arrested for DUI, Child Abuse

Below is a press release put out by Sarpy County Sheriff Department.  Unbelievable story of what the disease of alcoholism can make a person do.  If she would have had an ignition interlock she would have been forced to either walk to get her alcohol or have someone bring it to her.  Smart Start of Nebraska has two locations to have an ignition interlock device installed a very short drive from where this lady was arrested.

Sarpy County Sheriff arrested Krista Kay STIRES, age 30 of Bellevue this morning after a traffic stop.  The arrest was made near Kennedy Freeway (H.75) south of Bellevue.  STIRES was arrested for 4th offense DWI, Intentional Child Abuse and Driving under Suspension/Revocation.  She is currently being held with out bond at the Sarpy County Jail.
STIRES was arrested at 7:51 AM and tested over the legal limits of BAC .08.  Her Nebraska driving privileges are suspended/revoked from a previous DWI conviction.
It was discovered that STIRES had left her 3 ½ month old baby at home alone while she drove to replenish her alcoholic beverage supply.  The baby was removed and placed in care of Nebraska Health and Human services.

Seven Stopped for DUI in Grand Island, Nebraska Checkpoint.

Troopers with the Nebraska State Patrol Troop C Headquarters- Grand Island, arrested seven drivers for driving under the influence.  This enforcement effort was a success, removing impaired drivers and making roads safer in Nebraska.

Nebraska Cracks down on DUI over holiday.

During the holiday "You Drink, You Drive, You Lose" campaign troopers will put in extra hours to protect Nebraska roadways.  The Nebraska Office of Highway Safety (NOHS) grant of $27,000 will cover additional overtime hours.

Extra enforcement of accident causing violations will conducted in the following areas; Lincoln, Omaha, Norfolk, Grand Island,North Platte and Scottsbluff.
